I hereby apply to lease the above described premises for the term and upon the conditions set forth in this application. In addition to the non-refundable application fee of $50.00 CASH per married couple, or $50.00 CASH per each non-married room mate.

as earnest money to be refunded to me if the application is no accepted. Deposit money has to be certify check or money order, no personal check will be accepted.
If this application is not approved and not accepted by the owner or agent, the earnest money will be refunded, but not the application fee. The applicant hereby waives any claim for damages by reason of non-acceptance which the owner or his (her) agent may reject without stating any reason for so doing.
If Phoenix Realty of Wake Co, Inc approves this application, the earnest money shall be applied to the Applicant's security deposit. Upon receipt of Applicant's earnest money, Phoenix Realty agrees that the property will be taken off the rental market and all advertising discontinued. If Applicant fails to execute a lease on or before the move-in date, the earnest money shall be forfeited and it shall be treated as liquidated damages.
I hereby authorize Phoenix Property to whom this application is made, any credit bureau or other investigative agency employed by Phoenix Realty to investigate the references herein listed or statements or other data obtained from me or from any other person pertaining to my credit, financial responsibility and qualifications as lessee. I hereby release all parties from all liability for any damages that my result from furnishing this information to Phoenix Realty of Wake County, Inc. I hereby acknowledge that the above information is correct to the best of my knowledge.

If you fail to answer any question or give false information, the property may reject your application, retain all application fees and deposits as liquidated damages for its time and expense, and terminate your right of occupancy. Giving false information is a serious criminal offense. In lawsuits relating to the application or Lease Contract, the prevailing party may recover all attorneys' fees and litigation costs from the losing party. The property may at any time furnish information to consumer reporting agencies and other rental housing owners regarding your performance of your legal obligations, including both favorable and unfavorable information about your compliance with the Lease Contract, the rules and financial obligations.
